I have had occasion to consider the certificate of urgency dated 23/5/24 and supported by an affidavit of even date and which pleadings have only been accessible to this court today owing to technical challenges. Have perused the Petition and the Notice of Motion all dated 26/4/24, and having regard to the proceedings before Kariuuki J,and further noting the affidavit in support of the certificate of urgency and the annextures thereto, am persuaded that conservatory orders are necessary to maintain the status quo pending further directions/orders by the trial judge.
Accordingly, i allow prayer 2 of the Notice of motion dated 26/4/24 pending the mention of the matter on 20/6/24
