RULING

1. Following the Ruling in JR E395/2025, it became apparent that the Respondents had concentrated their energies to the other matter and had not filed any responses to the substantive motion herein which was filed in separate proceedings.

2. It is for that reason that I find that it would be unjust and unfair to render judgment in this matter as if it is undefended yet the Respondents had actively participated in the original proceedings, without any evidence that they neglected or lost interest in the substantive motion.

3. It could be that the Respondents may have presumed that had their application to set aside the orders for leave and stay been granted, then there would be no need to duplicate their efforts.

4. For the above reasons, and in order to accord each party an opportunity to be heard and for a merit balanced decision, I recall the judgment scheduled for today in this matter and grant leave to the Respondents to, within then (10) days of today, file and serve their responses to the application dated 29/12/2025, together with written submissions. The Exparte Applicants will have 2 days thereafter service to file and serve brief rejoinder submissions.

5. Mention on 11/3/2026 to fix a judgment date.

Dated, Signed and Delivered at Nairobi this 25 th Day of February, 2026
