RULING

By consent, the Application dated 23.06.2025 is settled as follows;

  1. There be a stay of execution of the Judgement and Decree dated 29.05.2025 pending the hearing and determination of the proceeding known as Eldoret Court of Appeal Civil Appeal No. E050 of 2025.
  2. The Applicant is directed to deposit a sum of Kshs.150, 000/= within 30 days as security for costs in Court.
  3. Each party will bear its own costs.
