1. The subject matter of this Ruling is the originating summons dated 23 rd October, 2025 whereof the applicant sought for the following orders:
(i) The Applicant be authorized to adopt the minor R.H.A.A
(ii) That upon adoption, the child be known as REGYN HOPE ADHIAMBO AYIEMBA
(iii) That the Registrar General be directed to enter this adoption into the Register of Adoptions and a subsequent Birth Certificate do issue by the Registrar of Births and Deaths
(iv) Costs of the application be in cause
2. The Applicant filed an affidavit she swore and a statement of facts in support of the summons.
3. Pursuant to the motion dated 23 rd October, 2025, this court proceeded to appoint Charles Mbuya Ogweno and Faith Achieng Odanga as legal guardian and guardian ad litem of the minor RHAA. This court further issued an order directing the Coordinator for Children Services, Nakuru County to carry out appropriate inquiries, write and file a report on the welfare of the minor RHAA who is the subject of the instant summons.
4. This court has considered the grounds stated on the originating summons plus the facts deponed in the supporting affidavit and the statement of facts. This court has also taken in account the report filed by the County Children’s coordinator, Nakuru plus the report of the Adoption Society.
5. The background of this matter is short and straightforward. It is not in dispute that the child was given up for adoption by the minor’s biological father. It is also apparent that the child has been under the care of the applicant together with the child’s father.
6. It came out clearly from the averments submitted to this court that the persons to be appointed as the legal guardians and guardian ad litem are ready and willing to take up their duties and discharge their mandates accordingly with respect to the minor. The legal guardian and the guardian ad Litem are necessary to safeguard the interest of the minor in these proceedings.
7. I have considered the report from the adoption society. The report indicates that the child (RHAA) was born on 12 th May, 2010 at War Memorial Hospital, Nakuru to the late Carolyn Atieno Ogweno and Joshua Otieno Ayiemba and that RHAA has been living with her biological father with the support from her maternal aunt Emily Awuor Ogweno.
8. It is the recommendation of Little Angels Network that the child is available for adoption and that it is in the best interest of the child. I have further considered the report from the County Children’s Coordinator and it is their recommendation that the applicant be allowed to adopt RHAA.
9. This court is also satisfied that the applicants and the child are related thus fulfilling the principle of local kinship adoption under sections 186(2) 186(8) and 193(1) of the Children Act, 2022.
10. In the end, I find the originating summons to be meritorious. It is allowed giving rise to issuance of the following orders:
(i) The applicant herein is authorized to adopt the minor namely RHAA.
(ii) The child to forthwith be known as Regyn Hope Adhiambo Ayiemba.
(iii) The Registrar General is directed to enter this adoption into the Register of Adoptions .
(iv) The Registrar of Births and Deaths is directed to issue Birth Certificate
(v) No order as to costs.
Dated, signed and delivered this 9 th day of June, 2026 at Nakuru.
