DUKE O. OMWENGA VS KENYA ORIENT INSURANCE CO. LTD

High Court at Nyamira High Court · · T. Cherere

1. Before the Court is the Notice of Motion dated 3rd June 2026 seeking, inter alia, judgment in favour of the Advocate/Applicant for KES. 156,374 being the amount certified in the Certificate of Taxation issued on 21st May 2026, together with the consequential orders sought therein.

2. When the application came up for hearing today, learned counsel for the Respondent, Ms. Langat, informed the Court that the application was not opposed. Counsel, however, prayed for a stay of execution for a period of thirty (30) days to enable the Respondent to make the necessary arrangements.

3. Having considered the application and the Respondent's concession, I am satisfied that the Applicant is entitled to judgment. Under Section 51(2) of the Advocates Act, where a Certificate of Taxation has not been set aside or altered, the Court may enter judgment for the sum certified to be due.
4. Consequently, the Notice of Motion dated 3rd June 2026 is allowed and I make the following orders:
1) Judgment is hereby entered in favour of the Advocate/Applicant against the Client/Respondent in the sum of KES. 156,374, together with interest as prayed in the application.
2) A decree shall issue accordingly.
3) There shall be a stay of execution for thirty (30) days from today.
4) The Advocate/Applicant shall have the costs of the application.
