DR. MARTIN AJUJO VS KIAMA WANGAI & COMPANY ADVOCATES

High Court at Milimani High Court · · R. E. Aburili

The application dated 2nd may 2025 is not certified as urgent, noting that on 17/4/2025 which was during the recess, the court received a chamber summons seeking to be heard during the recess but there was no application capable of being during the recess. In addition, the certificate of costs which is now sought to be set aside was issued in November 2024 which is over 5 months ago.
Thirdly if the applicant is challenging the taxation of a bill of costs by way of a reference, then the reference must be filed in the same proceedings where the taxation took place and not in a new file which has no historical court document on the process leading to the taxation.
These proceedings are found to be incompletely filed. They are hereby struck out with no orders as to costs. The applicant is at liberty to file an appropriate application in the matter wherein costs which are sought to be impugned were taxed.
