DR. ALLAN CHEMIST RAJULA VS POOL & SPA E.A LIMITED

High Court at Milimani High Court · · Visram Aleem Alnashir

1. I have considered the application dated 20th May 2024 seeking a stay of execution pending appeal. The same was opposed by the respondent vide a replying affidavit sworn on 11th June 2024.

2. The applicant offered to deposit the entire decretal sum as security pursuant to Order 42 rule 6.

3. The respondent contended the applicant ought to simply pay it the full amount instead.

4. Having considered the above, I am satisfied that the said offer for security is a sufficient condition to grant a stay.

5. A stay pending appeal is accordingly granted on condition that the decretal sum is deposited in a joint interest earning account in the names of the advocates on record within the next 30 days, failing which the stay will lapse.
