1. I have considered the Notice of Motion dated 12th February 2026 , the supporting affidavit sworn on the said date by Ms Dorah Awino , the applicant, as well as the annexures attached thereto. I have also perused the draft petition. The applicant avers that her husband, John Oyweya Halowe , is presently neurologically incapacitated, and that the court be pleased to grant her leave to file a petition for the appointment of a guardian ad litem and the management of the estate of Mr Halowe .
2. The medical report prepared by Dr. Rishad shows that Mr. Halowe had a brain injury and that he is presently incapable of managing his own financial affairs. I note that there is a medical bill owing to Pandya Memorial Hospital. That being the case, there is an urgent need for a manager to be appointed.
3. In the circumstances, I allow the Notice of Motion dated 12th February 2026 in terms of prayers 2 and 3 of the said Motion. I make no orders as to costs as this is an uncontested matter.
4. The petition will be mentioned before me on 19th February 2026 for directions.
5. It is so ordered
