Doorsun Consulting VS Kenya Pipeline Company Limited

High Court at Milimani High Court · · Visram Aleem Alnashir

1. The application dated 11 October 2023 together with the supporting affidavit of even date have been considered.

2. The respondent's replying affidavit sworn on 24th March 2024 has also been considered in opposition to the said application. Counsel did not however appear for the hearing/ highlighting of submissions.

3. The applicant submitted that the notice of appeal was filed in the court of appeal in time, although subsequently, there was a delay in filing further documents.

4. Counsel stated that in the event in the event the certificate of delay is not issued by the present court, it will be locked out of the appellate process entirely.

5. Having sought various clarifications from the applicant, I am satisfied that at this point, on balance, less prejudice will be occasioned to the parties by granting the applicant the orders sought in terms of prayer No. 4 than by denying the same.

6. Prayer No. 4 is accordingly duly granted.
