1. For hearing is the application dated 11th November, 2024. Pursuant to the directions of this court issued on 13th November, 2024, the same was to be served and responded to within 10 days if at all opposed.
2. I am satisfied that the application was served on the respondent as indicated in the affidavit of service sworn on 19th November, 2024. There has been no response to the application. The respondent is equally absent from today’s hearing.
3. I shall therefore presume that the application is unopposed. Having considered the same and in furtherance of the objectives under the Arbitration Act for speedy resolution of disputes, the application is hereby allowed.

Consequently, the Chartered Institute of Arbitrators, Kenya Branch is hereby designated as the Appointing Authority under the contract dated 12th June, 2012 for the One Stop Border Post at Busia Crossing under the East Africa Trade and Transport Facilitation Project [EATTPF] between the applicant and the respondent.
