'Upon hearing both learned counsels and taking into account the need to expedite the hearing of the matter and determine the substantive issues herein, I will allow the application dated 29th September, 2025 but on the following terms:
1. That the applicant is granted prayer 3 of the application so long as the amount of KShs.592,097/= is remitted to the respondent on the last day of each month save for the immediate payment which shall be remitted on or before 5th December, 2025.
2. The defendant/respondent shall file their statement of defence and counterclaim within 30 days from today.
3. The plaintiff/applicant shall file their response to (2) above within 14 days of service.
4. Thereafter parties shall file and exchange their respective documents and trial bundlers including statements of issues within 21 days each beginning with the plaintiff.
5. Case management conference before this court on 11th February, 2026.
6. The costs of the application shall be in the cause.
