1. I have perused the Notice of Motion dated 16th January 2026 vide which the appellant seeks a stay of execution of the judgment delivered on 5th December 2025 by the trial court pending the hearing and determination of the appeal.
2. The application does not show that execution is imminent. In the circumstances, I am of the view that the same ought to be served for a hearing on the merits. I therefore order that the application be served within three days of the date hereof for an interpartes hearing on 27th January 2026.
