The application dated 04.11.2023 is made under section 36 of the Arbitration Act. It is not opposed and the time for setting aside has lapsed. The application is allowed on terms that the Arbitral Award dated 27.05.2023 (Rtd Justice Mwera) is recognized as a judgment of this court and leave is granted for its enforcement as a decree. The Respondent shall pay costs assessed at Kshs. 50,000.00
