1. I have considered the undated application filed herein on 24th February 2026. I note that the same is in respect of the care and custody of a minor.
2. In my view, the matter ought to have been filed in the Children's Court as the said court has the primary jurisdiction. In the circumstances, I shall exercise my discretion under section 18(1) of the Civil Procedure Act and transfer this case to the said court suo moto.
3. This matter shall be mentioned before the Hon Nelly Chepchirchir on 3rd March 2026 for directions .
