DAVID CRISPO WERU CHIGITI VS State Law AND Director of Criminal Investigation AND 2 Others

High Court at Milimani High Court · · Jairus Ngaah

I have read the applicant's application dated 17 July 2023 filed under a certificate of urgency of even date. The application is certified urgent and leave is hereby granted in terms of prayers 2(a) and (b) of the chamber summons. The grant of leave shall also also operate as stay of the criminal proceedings as prayed in prayer (3) of the chamber summons. The substantive motion shall be filed and served within 21 days of the date of this order. Further directions on the hearing and disposal of the substantive suit shall be taken in the High Court sitting at Kerugoya for the reason that it has the requisite supervisory jurisdiction over the Chief Magistrates Court at Kerugoya where the the criminal proceedings sought to be impeached have been instituted.  For this reason I hereby direct that this matter be transferred to the High Court, at Kerugoya forthwith. It is so ordered.
