1. Before court is the application dated 12th June, 2024 seeking to extend the time for Official Receiver to file an objection to the automatic discharge of the Bankruptcy Cause dated 14th June, 2021 against the Estate of Kaushik Bhatt [deceased] and for the notice of objection to discharge the bankrupt to be admitted and for an order extending the Bankruptcy Cause of the said deceased bankrupt for a period of 6 months and the time for the Official Receiver as Bankruptcy Trustee.
2. The application is supported by an affidavit sworn by Raymond Korir on 12th June, 2024. The main reason for seeking extension is that the trustee in bankruptcy [Official Receiver] is yet to conclude the administration of the estate and that the Trustee requires to have the Title Deed to one of the bankruptcy property replaced.
3. I have considered the application, supporting affidavit as well as the notice of objection to discharge a bankrupt. I note that there is also no objection from the creditor herein. As such, the application dated 12th June, 2024 is allowed.
4. Consequently:
i. The notice of objection to discharge of bankrupt dated 10th June, 2024 be and is hereby admitted.
ii. An order is hereby issued extending the Bankrupt Cause against the estate of Kaushik S Bhatt [deceased bankrupt for a period of 6 months from 14th June, 2024].
iii. The term of the Official Receiver as banking trustee of the estate of Kaushik S Bhatt [deceased bankrupt] is hereby extended for a period of 6 months from 14th June, 2024.
iv. The lands registrar, Nairobi Central Registry is hereby directed to issue a new Lease/Title Deed in relation to LR No. 209/8294/354 situate in South C within Nairobi County to the Bankruptcy Trustee for purposes of the bankruptcy proceedings herein.
v. Matter shall be mentioned on 28th October, 2024 four months to confirm progress of bankruptcy.
