1. I have read the Notice of Motion dated 5th May 2025. The same is brought under sections 199, 200 and 201 of the Children Act, 2022 and is supported by the annexed joint affidavit of David Makewa Kasike and Magdalene Ngina Kyalinda, sworn in Mombasa on 5th May 2025.
2. Through the said affidavit, the Joint Applicants seek to have the Adoption Order amended on the basis that the same has errors. They aver that the said document states that the legal guardians of the child are "Hamisi Kunyetta Lubambo and Sarah Mbeke Makula". This is erroneous as the legal guardians appointed by the Court are "Anthony Muimi Mbuvi and Lois Ndinda Muimi". The Schedule to the Adoption Order also has incorrect details of the child, her sex and the name of the mother.
3. I have perused the application, the supporting affidavit and the annexures thereto. I am satisfied that the application has merit. The errors were evidently made by the Registry of this Court. In the circumstances, I allow the application. I order that the new adoption order be issued bearing the correct details, as issued by the Court.
4. I make no orders as to costs.
5. Orders accordingly.
