In the application dated 07.12.2022, the Appellant seeks stay of execution of the judgment of the Small Claims court pending appeal. I have heard the parties and I allow the application on the following terms:
1. There shall be a stay of execution pending appeal on condition that the Appellant shall deposit the sum of Kshs. 180,000.00 in court and pay to the Respondent Kshs. 18,000.00 as costs within 14 days from the date hereof. In default, the order of stay shall lapse.
2. Mention on 26.01.2023 before the DR to confirm filing of the Record of Appeal and for directions.
