Upon perusal of the memorandum of appeal dated 6/2/2024 and I do note that the same does not disclose any grounds of appeal at all wherefore there exists no grounds at all for interfering with the judgment of Hon. Barasa as delivered on 5/2/2024 and
I hereby strike out this appeal.
Summarily pursuant to the provision of Section 79B of the Civil Procedure Act Criminal Act Procedure 21 Laws of Kenya.
In light of the above the Appellants notice of motion dated 6/2/2024 has crumbles with the appeal and the said is thus dismissed with costs to the Respondent assets at Ksh.25,000 payable within 45 days from the date hereof and in default the Respondent be at liberty to execute.
