1. I have considered the Application dated 12 April 2023 together with the affidavit sworn in support of the same on even date.
2. The application is not opposed, and an affidavit of service has been filed evidencing service of the same.
3. Given that the counter claim exceeds the jurisdiction of the lower court I find it appropriate to grant the prayers sought and transfer the matter to the High Court.
4. The application is allowed as prayed for, save that costs shall be in the cause.
