I have considered the instant Misc. Civil Application filed under a certificate of urgency Vide a Notice of Motion dated 21st May 2026 together with the supporting affidavit and annextures thereto. I find that the application pertains to execution proceedings in a suit concluded in the Small Claims Court and ought to have been filed in the lower court not the High Court. It is my considered view that the application has not properly invoked this courts supervisory jurisdiction and is to that extent incompetent.
