' The Petitioner/Applicant''s Notice of Motion Application dated 21/11/2025 seeks leave of the Court to serve all 61 Interested Parties in this matter by substituted service to be effected by an advertisement of the Petition, Application, and Directions on the Court in one newspaper of nationwide circulation; with costs of the Application in the Cause
The Petitioner/Applicant states that this would allow the Petitioner/Applicant to comply with the Directions of this Court dated and issued on 18/11/2025 requiring service. In the Supporting Affidavit of Joy Nyariki, Counsel for the Petitioner/Applicant, it is deponed that despite due diligence the Petitioner/Applicant has been unable to trace or identify the physical or postal addresses, telephone numbers, email addresses, and/or places or residence or work of the Interested Parties for the purposes of regular service.
In that Supporting Affidavit dated 21/11/2025, it is averred that the Applicant''s information with regard to the 61 Interested Parties is limited to their names only as published on the Public Service Commission website and the impugned Kenya Gazette Notice.
Having considered this straight-forward Application and noting that it only seeks to comply with this Court''s Directions on Service and to give notice to and foster the participation by the Interested Parties, it is clear that the same is fit and ripe for summary determination as prayed.
Consequently, this Court finds merit in the Petitioner/Applicant''s Notice of Motion Application dated 21/11/2025 and grants prayers 2, 3, 4, and 5 or the same.
With Prayer 1 being spent, the Petitioner/Applicant''s Notice of Motion Application dated 21/11/2025 is fully determined by this Ruling, and it shall be thus marked. Orders and Directions accordingly.
DATED, SIGNED, AND DELIVERED VIRTUALLY ON THE 24TH DAY OF NOVEMBER IN THE YEAR 2025.
