In my ruling dated 17.03.2023, I directed the Plaintiffs to remedy any deficiencies in their Pleadings and Affidavits following the Defendants' Preliminary Objections. The Plaintiffs were to comply with the directions BY 21.03.2023 but they failed to do so. They sought more time which the court granted. The time limited for compliance was upto 24.03.2023.
When the matter came up today, 27.03.2023. to confirm compliance, neither the Plaintiffs nor their advocates were in court to offer any explanation for non compliance. I am therefore constrained to strike out the suit for non compliance with the court orders made on 17.03.2023 in particular for failing to file written authority to file suit. The interim orders in force are hereby discharged.
The Plaintiffs shall pay costs of the suit assessed at Kshs. 50,000.00 only.
