1. Pursuant to the ruling of 7th December, 2023, on the application dated 26th April, 2023, this court directed that said Stephen Mwai Muchene does attend court today, 26th February, 2024 to be examined as to the Judgment Debtor’s means and assets.
2. I am satisfied that the said Director of the Judgment Debtor company was served with the summons to appear in court physically as well as by phone [WhatsApp] as evidenced by the affidavit of service dated 20th February, 2024.
3. Having failed to attend court as directed and in light of the consequential orders in the application of 26th April, 2023, prayers 2, 3 and 4 kick in with the effect that the said Stephen Mwai Muchene shall be personally liable to satisfy the decree of this honourable court and the Decree Holder is hereby granted leave to execute the decree against the said Judgment Debtor personally.
