Chrispine Oduor Opondo VS O.C.S. Mikindani Police Station

High Court at Mombasa High Court · · Jairus Ngaah

I have read the applicant's application dated 17 December 2025, filed under a certificate of urgency of even date. The application seeks:
" MANDAMUS removing to this Court and quashing the decision of the Respondent's, their servant, agents, or representative of unlawful detention of Motor Vehicle Registration No. KBR 911K SCANIA and Trailer Registration No. ZD 1926."
I am not satisfied that the application is urgent. More importantly, the order for mandamus compels performance of a public duty. It does not quash a decision. The appropriate judicial review relief for quashing a decision is the order of certiorari. The applicant's application is thus incompetent and misconceived. Leave is declined, and the application is dismissed. It is so ordered.
