China Wu-yi Company Limited VS Suraya Property Group Limited

High Court at Milimani High Court · · Githiru Freda Mugambi

1.I have read the application dated 13th January, 2026 brought under Order 9 rule 13 (1) of the Civil Procedure Rules. I am satisfied that the application has been served upon the defendants as required, as confirmed by the affidavit of service of Lawrence Kimondo sworn on 9th April, 2026. I note that counsel for the plaintiff is not opposed to the application.

2. Accordingly, the application is allowed with the consequence that the firm of L Kimondo & Company Advocates is granted leave to cease acting for the 1st and 2nd defendants.

3. This is an old matter and it has a hearing date on 14th May, 2026. In order not to scuttle that date, let the hearing notice and the orders made by court today be served upon the 1st and 2nd defendants so as to give them notice to prepare for hearing or instruct counsel before then.

4. Hearing on 14th May, 2026 virtually.

DATED, SIGNED AND DELIVERED IN NAIROBI
THIS 5TH DAY OF MAY 2026.
