CHARLES ODOYO NGUKA VS EUNICE OLIVIA AWUOR NYAWANDA

High Court at Milimani High Court · · C. Kendagor

The applicant filed a case at the Children's Court in Nairobi (Case No. CC E2253 of 2025). The pleadings and proceedings indicate that the children involved in the suit are currently residing in Asembo, Rarieda Sub - County and that the defendant (respondent) is also residing there.
During the last court appearance, the Children’s Court made a finding that the Nairobi court did not have territorial jurisdiction over the case and recommended that the parties seek a transfer order from the High Court. The applicant (Plaintiff) has indicated that the nearest court is Bondo Law Courts.
The application was served, and the respondent did not oppose the same despite service.
I have reviewed the application and the file before the Children’s Court in Nairobi. The transfer will not prejudice any party, as it is a procedural step intended to facilitate the administration of justice. I am satisfied that the best interests of the children will be served by transferring the case to the nearest court, Bondo Law Courts, due to its proximity to both the children and the defendant.
The application for transfer is allowed. The Nairobi Children Case E2253 of 2025 is hereby transferred to Bondo Law Courts. The record shall be transmitted forthwith, and the parties are directed to appear before the Head of Station at Bondo Law Courts on 10th March, 2026, for directions.
The Misc. File is spent following the above orders and is hereby marked as closed.
