Charles Atiang Atyang VS Cabinet Secretary Ministry of Agriculture, Livestock and Fisheries

I have considered the application by Kenya Sugar Manufacturers Association dated 8 May 2024 filed under certificate of urgency of even date. An earlier application for joinder by the same Association is set for hearing on 27 May 2024. In that application, the prayer to set aside or vacate the previous order I made on grant of leave to file the substantive motion was refused. It is the same prayer, that Kenya Sugar Manufacturer's Association, though not yet party to these proceedings, is seeking in this application. Until the application for joinder has been heard and Kenya Sugar Manufacturers Association joined to these proceedings, the Association has no locus upon which to seek for the setting aside of the orders that have been made in these proceedings. For these reasons, I decline to grant the orders sought and direct that this application be heard on 27 May 2024. It is so ordered.
