CATHERINE ANYANGO OMBIMAH VS National Transport And Safety Authority AND AUTOBOX MOTORS LIMITED

High Court at Milimani High Court · · Prof. (Dr.) Sifuna Nixon

1. This is a ruling on an Application by Applicant, to be joined to this suit, as an Interested Party. I have considered the Application. The legal threshold for an Application for joinder of an Interested Party, was firmly reiterated in Trusted Society of Human Rights Alliance v. Mumo Matemu & 5 Others [2014] eKLR , where the Supreme Court of Kenya reiterated the principles for joinder as an Interested Party.

2. It stated that an Interested Party is a person ab initio , who although is not a party to a suit, has a stake in the proceedings. One who will be affected by the decision of the court when it is made either way. In my view, such a person has to demonstrate that he or she has a stake in the suit or the subject matter of the suit.

3. This latitude is generally wide. I find that the Applicant has in this Application demonstrated that it has an interest in the subject matter of this suit. I therefore allow the Application, but with no order as to costs. This is in terms that the Applicant is hereby joined in this suit as an Interested Party.
