CAELAN WESONGA MUTIMBA VS The Republic

High Court at Milimani High Court · · Alexander Muasya Muteti

The applicant seeks a review of Bail terms. He had proposed that a sum of Ksh. 50,000/= would be ideal as per the certificate of urgency dated 30th September 2024.

However, during the Hearing of the application he has pleaded to have the court admit him to Ksh. 20,000/= cash Bail. The prosecution is not opposed to review of the Bail terms. The accused is charged with the offence of stealing. The sum involved is Ksh 300,000/=. He has been in custody for 14 months unable to raise bond.

It is clear to me that this is a deserving case for review of Bail terms. The accused is admitted to bail in the following terms:

  1. Deposit Ksh. 20,000/=
  2. The accused sister by the name LINET ACHOLA MOMBO OKWARA is to sign a Bond of Ksh. 50,000/= to ensure that the accused attend court as and when required by the court.
  3. It is so ordered.
