The Applicant has moved the court by the application dated 07.01.2022 made under section 37 of Arbitration Act seeking to enforce an arbitral award issued on 11.11.2021 by Mr Peter M. Waiyaki, Sole Arbitrator. The Award has not been set aside and the time prescribed for doing so has now lapsed. The Applicant has complied with all the formal requirements for recognition and enforcement consequently I allow the application on the following terms:
1. The Arbitral Award issued on 11.11.2021 by Mr Peter M. Waiyaki, Sole Arbitrator be and is hereby recognized as a judgment of this court and a decree shall issue accordingly
2. Leave be and is hereby granted to the Applicant to enforce the said Arbitral Award.
3. The Applicant is awarded costs of the application assessed at KES. 40,000.00 only.
