(From the original conviction and sentence in Kisumu Chief Magistrate’s Court Criminal Case No. E223 of 2024)
1. On 27th May 2024, the convict Benta Awino Onyango was sentenced to pay a fine of Kshs.50,000 in default to serve 6 months imprisonment for the offence of being in possession of 100 litres of alcoholic drinks.
2. She pleaded guilty to the charge. She has served 11/2 months. She mitigated saying she had children but the prosecution said they were safe and in good hands.
3. I note that on 27th May 2024, this matter was before me vide Criminal Revision No. E130 of 2024 and I suspended the prison term imposed for 6 months.
4. Accordingly, this file is overtaken by events of the previous prison decongestion exercise. The file is closed.
