I have seen the application dated 28 October 2025 filed by Henry Manyange, the 4th defendant.
It seeks orders of injunction to restrain the plaintiffs from threatening the tenants in the premises Kisii Municipality/Block III/140 until the conclusion of the suit. The applicant avers that after the court took the submissions of the parties on 14 October 2025, she walked to the premises celebrating that she has won the case and demanded that the tenants not to pay rent to him.
I observe that this matter is pending ruling on a report of the National Land Commission and the court already took submissions on the same. The ruling is reserved for 19 November 2025. No party should pre-empt the ruling of the court until it is delivered.
I will order that the status quo be maintained in the premises Kisii Municipality/Block III/140 until the ruling is delivered on 19 November 2025. No party should attempt to go to the premises to threaten a disruption of the status quo.
It is not necessary for the application to be heard inter partes.
It is so ordered.
DATED AND DELIVERED THIS 29 DAY OF OCTOBER 2025
JUSTICE MUNYAO SILA
JUDGE, ENVIRONMENT AND LAND COURT
