1. The originating summons dated 26 th February 2026 came up for hearing today.
2. The application is unopposed. Affidavit of service is filed dated 15 th June 2025 to effect that
service was effected on the Clerk of Wajir County on 12 th June 2026 at 11.23 a.m.
3. The notice of hearing was annexed. The court is satisfied with service. On merit of the
originating summons, the court noted the exhibit of the Decree dated 10 th November 2022 and
issued on 21 st February 2024 and the certificate of taxation dated 16 th February 2024, and the
certificate of Order against Government for a total sum of KShs.643,005 dated 24 th April 2026.
4. The Applicant is in compliance with the provisions of the Government Proceedings Act.
5. The court is pleased to issue an order of mandamus compelling the Respondent, Wajir
County Assembly Service Board to settle in full Kshs.643,005/= as per the certificate of order
against the Government plus accrued interest at court rate in Nairobi ELRC No. 106 of 2016.
6. Cost of the Application awarded to Applicant.
7. It is so ordered.
