I have read the originating motion dated 30 th January 2026 and supporting affidavit of Nyikin John Mark sworn on 30 th January 2026. It is alleged that the respondents’ motor vehicle registration number KDN 555V is proceeds of crime for having been used in conveying narcotic drugs. The vehicle is shown to be registered to the respondent with the interested party being a financier of the same.
The deponent of the supporting affidavit avers that the sole director of the respondent is one Miss Mercy Chepngeno Ngetich. The vehicle was intercepted on 15/1/2026 in Kyumbi Machakos after its tyres were deflated when the police stopped it and it defiled the orders. The vehicle was then searched and 12 sacks and long loose rolls of dry plant material found therein. The material was later tested and confirmed to be cannabis. This in my view is evidence enough to establish a reasonable suspicion that the vehicle was used in commission of a crime.
Based on the above and other averments contained in the affidavit, I am convinced that the application is merited. The same is allowed in terms of prayers 2, 3, 4 and 5.
The applicant shall gazette the orders herein within the period provided in law.
The file is closed.
Dated signed and delivered at Nairobi this 2 nd day of February 2026.
