' This is an application brought under Sections 81 and 82 of the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA) seeking to preserve motor vehicle registration number KCY 421W on account that the same is proceeds of crime having been purchased using money generated from dealing with narcotic drugs.
In the supporting affidavit of the investigator one Joel Saitoti sworn on 24/11/2025, it is deponed that the respondent has been doing business with people suspected to be dealers in narcotic substances specifically one Mohamed Guyo who has been charged in Kahawa law courts vide criminal case Number E036 OF 2024. Other than Guyo, the respondent’s account shows suspicious and large transactions, some of which are cross-border.
I have read through the said affidavit and annextures and I am convinced that there are reasonable suspicions that the motor vehicle was purchased using proceeds of crime.
The respondent has not explained to the applicant his sources of income yet the transactions he is seen doing with the people suspected and charged in court with offences of dealing with narcotics drugs are not ordinary. An explanation is required.
In the circumstances, the motion dated 24/11/2025 is allowed in terms of prayers 2, 3, 4 and 5.
