' The applicant has approached this court vide application dated 3/12/2025 seeking to preserve motor vehicle registration number KDA 057F under Section 81 and 82 of the Proceeds of Crime and Anti-Money Laundering Act. The application is supported by affidavit of Benford Mariuki sworn on 3/12/2025. It is deponed that the respondent owns the said motor vehicle which was intercepted by police on 10/6/2022 while transporting plant material which after tests was found to be Canabis Sativa. The respondent was charged in Kahawa law courts with offence of trafficking in narcotic drugs through criminal case number E049 OF 2022 which case is still ongoing.
The respondent has also been charged in another case of trafficking in narcotic drugs vide JKIA law courts case number E066 OF 2025. She is currently at Langata women prison and has declined to record statement to explain her source of income for acquisition of the motor vehicle.
Going by the above and the fact that the vehicle is registered to the respondent, it is my finding that the applicant has established grounds for granting of the orders sought.
Consequently, the application dated 3/12/2025 is allowed in terms of prayers 2 and 3 thereof. I make no orders as to costs.
