The Applicant herein has moved this court under Sections 81, 82, 94 and 131 of the Proceeds of Crime and Anti-Money Laundering Act and Order 51 Rule 1 of the Civil Procedure Rules seeking preservation of various properties as set out on paragraph 12 of the application.
Further, the Applicant has also sought for preservation orders for funds held at Kenya Commercial Bank Limited at K.I.C.C Branch.
The application was brought under certificate of urgency. The court has read through the affidavit in support of the application and there are reasonable grounds to believe that the properties and the funds held in A/c Nos. 1240221339 KCB Bank KICC and A/c Number 1292910038 also at KCB KICC Branch were acquired using illegitimate proceeds and thus are proceeds of crime.
For the reason stated herein above, I find that the application has merits and I hereby allow the same in terms of orders (1), (2), (3), (4), (5), (6), (7) & (8).
The orders are valid for 90 days pursuant to Section 84 of the Proceeds of Crime and Anti-Money Laundering Act.
It is so ordered.
