Assets Recovery Agency VS HEZRON WANJOHI NJERI

High Court at Milimani High Court · · Lucy Njuguna

The applicant has moved this Honourable court by way of the Notice of Motion dated the 17/07/2025.

The application is based on the grounds set out on the body of the same and it's supported by the annexed affidavit sworn by Peter Mutisya, who is an investigator with the applicant. The applicant has sought for the Orders set out in the application.

The applicant has averred that the respondent who was an employee of St. Fatuma Mweiga School, occasioned loss of Ksh.34, 121,115 between the year 2021 and 2025.

That the loss was occasioned through inflated salary, making documents without authority, obtaining money by false pretences. That he could thereafter transfer the money into his accounts domiciled in Equity Bank, New Forties and Wananchi Saccos and to accounts associated with his co-accused Cecelia Nyaguthi.

That the respondent and Cecilia Nyaguthii were charged with various offences to wit; Conspiracy to defraud, Stealing by Clerk, False accounting and Making a document without Authority, which case is still pending in court.

That the applicant sought Orders to investigate the respondent's accounts, and it has reasons to believe that the monies held in those accounts are Proceeds of Crime from the respondents through conduct of fraudulent activities. It has, therefore, urged the court to grant conservatory Orders.

The Court has considered the application and the Supporting affidavit. Am of the considered view that the applicant has established reasonable grounds to warrant granting of the Orders sought herein.

The application is allowed in terms of Prayer (2).
It is so ordered.
