Background
It is unfortunate that the court record does not reflect the orders on security for costs which both parties have alluded to. In order to expedite the matter and in the interest of justice, I will give the further benefit of doubt to the appellant by directing that the application dated 30th May, 2024 is compromised in the following way:
1. The amount of KShs.400,000/- be deposited in a joint interest earning account in the names of both advocates within 30 days. In default, the stay orders shall automatically lapse.
2. Replying affidavit be filed and served in this period. Mention on 26/2/2025.
