RULING
1. Whereas this file had been listed for revision of the applicants’ sentence in line with the judiciary’s prison decongestion exercise, I have upon perusal of the trial file Makadara MCTRE 1942/2026, established that the applicants, Anthony Musyoka and Daniel Furaha were charged with the traffic offence of failing to wear conductors prescribed PSV badge contrary to sections 103A (1) as read with section 103A (7) of the Traffic Act CAP 403 of the Laws of Kenya.
2. The case against the 2nd applicant was withdrawn under section 87 (A), while the 1st applicant was convicted own his own plea of guilty and he was sentenced on 1.4.2026 to a fine of Ksh 10,000 or a custodial term of one month.
3. The 1st applicant has already served his custodial term.
4. Premised upon the reasons aforesaid, this file is hereby marked as closed.
