Annah Njoki Nganga VS JULIUS HANNINGTON OUMA

High Court at Milimani High Court · · Jairus Ngaah

I have considered the applicant's application dated 16 May 2023 filed under a certificate of urgency of even date. At the heart of the dispute between the applicant and the interested party is the landlord-tenant relationship and whether the Nairobi Rent Restriction Tribunal has jurisdiction to make the orders that are sought to be challenged in the event leave to file an application of judicial review is granted. Appeals and other applications arising from such disputes fall within the jurisdiction of the Environment and   Land Court. For this reason, I direct the application transferred to the Environment and Land Court for disposal or for such other orders that the Presiding Judge,  or any other Judge in that court,  may deem fit to grant. It is so ordered.
