1. This court has considered the Applicant's application seeking that the period he stayed in remand during trial being 1 year and 6 months be factored in his sentence of 22 years.
2. Having perused the records of the trial court in Mariakani Criminal Case No. 50 of 2009, it is confirmed that the Applicant was never released on bond and as such he is entitled to benefit under Section 333(2) of the Criminal Procedure Code.
3. Having confirmed that death sentence passed against him at trial was substituted with 22 years in jail in Mombasa High Court Petition No. 63 of 2018, the said sentence is hereby ordered to run from 26th January 2009.
