In my ruling dated 13.05.2023, I directed the Arbitrator to show cause why he should not be paid his fees as the parties had conceded to the challenge and agreed that the reference should start afresh before another arbitrator.
Despite service of the ruling and notice for today’s date, the arbitrator has not appeared to show cause. In the circumstances and no cause having been shown, I order as follows:
(a) That the Arbitrator, ENG. HOWARD M’MAYI, shall not be paid any fees or costs in the matter.
(b) There shall no order as to costs in this matter.
