'I have read the applicant''s application dated 4 September 2025, filed under a certificate of urgency of even date. I cannot fathom how the respondent can be undertaking what the applicant has described as unauthorised salvage operations without the blessings of the Kenya Ports Authority, which is named as one of the interested parties in this suit. I would suppose that Kenya Ports Authority would be the first entity to take appropriate action if there are any unauthorised activities being undertaken within its jurisdiction. Accordingly, I am not satisfied that the application is urgent. I direct that the same be served for directions on the mode of its disposal on 22 October 2025. It is so ordered.'
