The Applicants application dated 08.03.2023 is dismissed with costs. The Small Claims Court having dismissed the Counterclaim, the Applicant cannot file an application purporting to enforce what was in fact dismissed. The proper procedure would be to file an appeal against the dismissal or otherwise file a fresh suit to agitate the issue. Costs of assessed at Kshs. 20,000.
