AFRICA MERCHANT ASSURANCE COMPANY LIMITED VS CHIEF MAGISTRATE COURT AT RUNYENJES AND ABEL MWANIKI

High Court at Embu High Court · · Anthony Ndungu

I have considered the application by way of chamber summons dated 24/5/24 brought under a certificate of urgency. I certify matter urgent.

On the material before court am satisfied that the applicant has established an arguable case deserving of ventilation at an inter parte hearing. Accordingly i grant leave in terms of prayer 2.

I have considered the prayer that the leave so granted do operate as a stay. I am satisfied that if stay is not granted, the application may be rendered nugatory. i allow prayer 3 in the chamber summons.

The substantive motion be taken out and served within 21 days. Responses within 14 days of service.

The delay in the handling of this certificate is regrete. Same has been occasioned by system challenges.

Mention on 18.9.24 for directions as to hearing.
