I have considered the application brought under a certificate of urgency. For reasons stated, i certify matter as urgent. Further, on the material before court, and, in order that the intended appeal is not rendered nugatory, am persuaded that it is in the interests of justice that an interim order of stay proceedings before the trial court be granted pending the hearing of the application. Staying of due process in a competent court is a drastic measure. In that regard, the Appellant is put on notice that even during the pendency of this application, the appellant must move with speed to prepare the appeal for a quick disposal.
Meanwhile, the appellant is to serve the application forthwith. A response be filed within 14 days. The application shall be disposed of by way of skeletal written submissions in the following order;
1. The appellant within 7 days of service of response.
2. The respondent within 7 days of service of rival submissions.
