Article 48 of the Constitution requires the State to ensure access to justice. The Legal Aid Act, 2016 established the National Legal Aid Service (NLAS) to provide free legal services to people who cannot afford them.
Legal aid is available to indigent persons — those who cannot afford legal services — and certain vulnerable groups, including children, refugees and victims of human trafficking. Applicants are assessed on their means.
In criminal cases, Article 50(2)(h) entitles an accused person to an advocate assigned by the State at State expense if substantial injustice would otherwise result — commonly applied in capital cases.
Contact an NLAS office or a court-based legal aid desk, fill in the application form and provide information about your means.
