Under the Limitation of Actions Act (Cap. 22), an owner who does not act to recover land within twelve years of being dispossessed can lose the right to do so. The occupier may then apply to the Environment and Land Court to be registered as owner.
Courts require occupation that is:
A tenant or licensee who occupies with permission cannot claim adverse possession while that permission continues.
The claim is brought by originating summons in the Environment and Land Court, supported by an affidavit and evidence: witnesses, photographs, developments on the land, payment of rates.
Public land cannot be acquired by adverse possession.
